Weekly Rest and Sunday Closing

Am I entitled to a day of rest from work each week?

Employees who usually work 20 hours or more per week get 24 consecutive hours away from work once every seven days. Persons employed in the retail trade get two consecutive days off every seven days. In the retail trade, the two consecutive days off do not apply to:
  • businesses with less than 10 employees; or
  • employees who work less than 20 hours per week.

A variance to be exempted form this provision can be applied for to the Labour Standards Division.

Is my workplace allowed to open on Sunday?

Generally, there are no restrictions upon establishments opening on Sunday.

Who determines if my workplace can be open on Sunday?

The discretion is left to each municipality.

Does my municipality (town, city, etc.) have the power to permit my workplace to open on Sunday?

Yes; municipalities have the power to pass by-laws on store hours and exemptions.

What legislation determines the day of rest and Sunday openings?

The Labour Standards Act and the federal Lords’ Day Act and Urban Municipality Act make the above provisions.
