Prince Edward Island Weekly Rest and Sunday Closing Am I entitled to a day of rest from work each week? Employees are entitled to a rest period of at least twenty-four consecutive hours in every period of seven days and, whenever possible, that rest period shall include Sunday.
This does not apply to salespeople working primarily on commission, or farm labourers. Is my workplace allowed to open on Sunday? Retail establishments are allowed to be open within the provisions of the Federal Lords’ Day Act, namely between the last Sunday in November and the Sunday preceding Christmas.
Most establishments are required to close, but there are some exceptions, including: drug stores, motor vehicle service stations, convenience stores, and usually, upon application, retail businesses in tourist areas. When establishments can open there are sometimes restrictions on the number of employees working.
Does my municipality (town, city, etc.) have the power to permit my workplace to open on Sunday? No.
What legislation determines the day of rest and Sunday openings? The Employment Standards Act provides for the day of rest provision above. The Federal Lords’ Day Act provides some of the above provisions. Those requiring most businesses to close, with some exceptions, are provided by the Retail Businesses Holidays Act. |
