Weekly Rest and Sunday Closing

Am I entitled to a day of rest from work each week?

Employees are entitled to a period of rest of not less than 24 consecutive hours during each week of employment, this period of rest shall be a Sunday wherever possible.

This does not apply to certain employees, including:
  • Employees whose employer has applied for and received from the minister a written exemption from subsection; or,
  • Employees engaged in work of an emergency nature

Is my workplace allowed to open on Sunday?

Most establishments are required to close, but there are some exceptions, including: drug stores, motor vehicle service stations, convenience stores, and usually, upon application, retail businesses in tourist areas. When establishments can open there are sometimes restrictions on the number of employees working.

Does my municipality (town, city, etc.) have the power to permit my workplace to open on Sunday?

The Minister responsible may issue an order to give effect to municipal regulations, in effect; it does not appear these provisions are being used.

What legislation determines the day of rest and Sunday openings?

The Labour Standards Act and Shops’ Closing Act provide the above regulations.
