New Brunswick Making a Complaint How do I make a complaint? If you think your boss has violated your employment rights, there are several ways to go about filing a complaint. You can:
- Contact the Employment Standards Branch by phone toll-free at 1-888-452-2687
- Write the Department of Training and Employment Development, Employment Standards Branch, P.O. Box 6000, Fredericton NB E3B 5H1.
Are there time limits for filing a complaint? Yes. You must file your complaint within 12 months of the date the problem occurred.
Can I make a confidential complaint? Your complaint may be kept confidential if the Branch feels there might be intimidation or retaliation against you. But the Branch could refuse to act on your complaint if it's felt that keeping your identity secret will block the investigation or be unfair to your employer.
What happens after I file the complaint? An Employment Standards Officer will contact you and your employer and determine whether the law has been broken. The officer might try meditation, but if that fails or isn't attempted, there will be an investigation.
If you or your boss aren't satisfied with the outcome of the investigation, either one of you can take your case to the Labour and Employment Board within 10 days of receiving the written decision on the investigation. You and your boss will be able to appear before the board in a hearing to present your arguments. The board will make a final and binding decision on your complaint. It can uphold, overturn or change an order, or dismiss your complaint.
Any order from the Director of the Employment Standards Branch or the Board requiring payment of money owed to you can be filed in the Court of Queen's Bench and enforced as a judgment. |
